DRAFT — requires lawyer review. Version 2026-10-25-draft.

Terms of Service

These Terms of Service (“Terms”) govern your use of AIQ, a software product of Tastemaker Collective LLC, doing business as Social IQ (“Social IQ”, “we”, “us”). By using AIQ, running a free check, asking for a report or creating an account, you agree to these Terms and to our Privacy Policy.

1. What AIQ does

AIQ checks how often AI assistants such as ChatGPT, Claude, Perplexity and Gemini name a business when asked questions customers ask, reviews how easily AI tools can read the business's website, and suggests improvements. It includes a free AI visibility check, reports, AIQ accounts and, when available, paid services.

2. Who can use AIQ

  • You must be at least 18 and use AIQ for business purposes.
  • You may run checks on any business, including one you don't own or represent, for example to research a prospect. Checks use public information about the business.
  • Don't use AIQ or its reports to mislead anyone about a business, or to suggest that a business, Social IQ or an AI provider endorses you.
  • Give accurate information, and keep your account's sign-in details secure. You're responsible for activity in your account.

3. The free check

  • The free check is free. We may limit how many checks a person, website or email address can run, show an earlier result for a repeat check within 7 days, and pause or stop the free check at any time.
  • We ask AI assistants a sample of questions, several times each. Their answers vary from one run to the next, so results are estimates with a range, not exact measurements.
  • AI assistants are run by independent companies. We don't control their answers, aren't affiliated with or endorsed by them, and can't guarantee how they'll describe or recommend any business.

4. Reports

You may use and share your report. If it's about a business you don't represent, present it accurately: as AIQ's estimate at the time of the check. A report's address works for anyone who has it, so share it with care. Reports reflect AI answers and public information at the time of the check, and may contain errors from those sources.

When you ask for a report, we email it to you and may follow up by email about it and Social IQ's services. You can unsubscribe at any time with the link in any email.

5. Recommendations and your website

AIQ's suggestions, including suggested page wording, are recommendations. You decide whether to use them and you're responsible for changes you make to your website and listings, including making sure they're accurate. We don't guarantee that following them will change how AI assistants or search engines treat your business.

6. Paid plans

  • Prices are shown in AIQ before you subscribe, in US dollars, and don't include any taxes that apply. Payment is handled by Stripe; we don't receive or store your full card number.
  • Plans renew automatically, monthly or yearly as you chose, and we charge the card on file at the start of each period until you cancel.
  • You can cancel at any time in AIQ under Settings → Billing → Manage billing. Cancelling stops the next renewal; you keep the plan until the end of the period you've paid for. We don't refund the rest of a period, except where the law requires it.
  • A founding-client rate, when offered, applies for as long as your subscription continues without a break. If you cancel and later subscribe again, the plan's standard price applies.
  • If a payment fails, we and Stripe will retry it and let you know. If it still fails, we may pause or end the plan's paid features.
  • We may change prices for future periods. We'll tell you at least 30 days before a change applies to you, and you can cancel before it does.

7. Acceptable use

You agree not to:

  • get around limits, the security check or other protections, or use automated means to run checks;
  • use AIQ to harass anyone, misrepresent a business, or for anything unlawful;
  • copy, resell or scrape AIQ, or reverse engineer it except where the law allows;
  • interfere with AIQ's operation or security, or try to access data that isn't yours;
  • submit information you don't have the right to share;
  • use information from AIQ to send messages that break anti-spam laws, or to make false or misleading statements about a business.

8. Your information and our rights

You keep your rights in the information you give us, and allow us to use it, and public information about your business, to provide AIQ and as described in our Privacy Policy, including in aggregated statistics that don't identify you or your business.

AIQ, its software, design and content (other than your information) belong to Social IQ and its licensors. If you send us suggestions, we may use them without obligation.

9. Third-party services

AIQ relies on and links to services run by others, such as AI assistants, Cal.com and websites mentioned in reports. Their own terms apply to your use of them, and we aren't responsible for them.

10. Disclaimers

AIQ is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and don't promise that AIQ or its results will be accurate, complete, uninterrupted or error-free.

11. Limitation of liability

To the extent the law allows, Social IQ won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, and our total liability for any claim relating to AIQ is limited to the greater of the amount you paid us for AIQ in the 12 months before the claim and US$100. These limits don't apply to liability for gross negligence, willful misconduct, breach of confidentiality, or the indemnification obligations in section 12.

12. Indemnity

You'll defend and indemnify Social IQ against third-party claims arising from your breach of these Terms, your misuse of AIQ, your violation of law or of anyone's rights through your use of AIQ, or changes you make to your website or listings.

We'll defend and indemnify you against third-party claims that AIQ itself, as we provide it, infringes someone else's intellectual property. This doesn't cover claims arising from your misuse of AIQ, your content, or your combining AIQ with things we didn't provide.

13. Suspension and ending

You can stop using AIQ at any time. We may suspend or end access if you breach these Terms or to protect AIQ or others. Sections that by their nature should continue (such as 8 to 14) survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-laws rules.

You and Social IQ agree to resolve any dispute relating to AIQ or these Terms by binding individual arbitration, administered by the American Arbitration Association under its Commercial Arbitration Rules, in Clark County, Nevada. Either of us may instead bring an individual claim in small claims court, or ask a court for an injunction to protect intellectual property. Judgment on the award may be entered in any court with jurisdiction.

Disputes are resolved only individually: neither of us may bring or take part in a class, collective or representative action, and the arbitrator may not combine claims of more than one person. You and Social IQ each waive the right to a jury trial. If this class-action waiver is found unenforceable, the dispute goes to the state or federal courts in Clark County, Nevada, instead of arbitration.

This section is provisional: it is the part most likely to change after legal review, because Social IQ operates in California.

15. Changes

We may update AIQ and these Terms. Each version has a version number, shown at the top; we record which version you accepted when you ask for a report. Material changes apply going forward, and we'll give notice where appropriate.
